Trademark Search in Pakistan: Why It Matters Before You File

A trademark search before filing with IPO-Pakistan isn't a formal requirement, which is exactly why it gets skipped more often than it should be. It's optional in the narrow sense that IPO-Pakistan won't reject your application simply for not having done one. It's not optional in any practical sense if you actually want the application to succeed without an expensive surprise months in.

This piece explains what a proper search actually checks, what happens when businesses skip it, and when in your branding process a search should realistically happen.

What a search actually checks

A proper search looks at IPO-Pakistan's existing trademark register for marks that are identical or confusingly similar to yours, within the same or related classes of goods and services. This includes checking similar-sounding names, similar visual logos, and marks that overlap in the category of business even if the specific name itself differs from yours.

A thorough search also considers phonetic similarity, names that sound alike when spoken even if spelled differently, since IPO-Pakistan's examiners weigh this alongside visual and conceptual similarity when assessing whether two marks would confuse consumers.

What happens if you skip it

Filing without a search doesn't mean automatic rejection. It means finding out, sometimes eight or more months into the process during the publication and opposition window, that a similar existing mark is being used against your application. At that point you've lost the time already invested, and you're dealing with a formal opposition rather than simply having chosen a different, available name from the start.

By the time an opposition surfaces, a business has often already built signage, packaging, and marketing materials around the name in question, which makes an opposition considerably more costly in practical terms than it would have been to simply pick a different name before any of that investment happened.

A search doesn't guarantee approval, but it changes the odds substantially

No search is perfect, and a clean search result doesn't eliminate all risk of opposition, since new applications can still be filed by others during your own application's pending period. What a proper search does is remove the most common and most avoidable cause of a failed or delayed application: a mark that was already taken in an obvious, findable way that a basic check would have caught.

When to search relative to other business decisions

Ideally, a trademark search happens before you've invested heavily in branding, packaging, or a domain name built around a specific name, not after those costs are already sunk. Finding out a name is unavailable before printing signage is a minor inconvenience that costs a few days. Finding out after printing signage and registering a domain is a considerably more expensive one.

How a search connects to company registration

It's worth noting that SECP checking your proposed company name for availability is a completely separate process from an IPO-Pakistan trademark search, and clearing one doesn't mean you've cleared the other. A company name can be approved by SECP while still infringing on someone else's registered trademark, which is a gap that catches founders off guard if they assume passing one check means they're clear on both.

What a search typically reveals

Beyond an outright conflict, a search sometimes reveals a crowded space, several similar marks in the same category, which is useful information even when none of them technically blocks your specific application. It can inform a decision to adjust the name slightly or strengthen the distinctiveness of the logo before filing, improving your odds during examination.

What it costs relative to what it protects

A trademark search is a modest cost relative to the branding investment it protects and relative to the cost of an opposition fought after the fact. We include a proper search as part of every trademark registration we handle, rather than treating it as an optional add-on most clients would skip if given the choice.

A realistic scenario worth learning from

A founder picks a catchy name, registers the company with SECP, builds a website and social presence around it, then files a trademark application ten months later once the business is established. The application gets opposed by an existing mark holder in a related category that a basic search would have surfaced on day one. The founder now faces a choice between fighting the opposition or rebranding an established business, neither of which would have been necessary with a five-minute search before any of that investment happened.

This scenario isn't unusual; it's close to the most common pattern we see in trademark disputes that reach us after the fact, which is exactly why we push clients toward searching before falling in love with a name rather than after.

How this connects to the rest of your registration journey

A trademark search sits naturally alongside the broader process of getting a business properly set up: company registration establishes the legal entity, the trademark search and filing protects the brand identity, and depending on the business, PSEB or PSW registration unlocks specific operational benefits. Handling these in a sensible order, rather than addressing brand protection as an afterthought once everything else is already built, tends to save both money and stress.

Common questions

Can I do a basic search myself before paying for a professional one? You can check IPO-Pakistan's public register yourself for an obvious conflict, though a professional search considers phonetic and conceptual similarity a basic name check often misses. How long does a proper search take? Typically just a few days, which is a small addition to the overall 12 to 18 month registration timeline.

Pak Register includes a proper trademark search as the first step of every trademark registration in Pakistan we handle, before any application is filed, specifically to avoid the scenario of an opposition surfacing months into a process that could have been avoided entirely. Get in touch before you fall in love with a name, and we'll check it's actually available first.
